Summary, etc. Description<br/>For the purposes of this edition, judicial decisions have been the only source of growth and further expansion of the meaning and application of the provisions of the Act. Death has been awarded for brutal killing and rape of a child. It is not necessary that there should always be some independent witnesses in every case. Evidence of family members who may be the only persons witnessing the happening inside the house has been held to be good evidence. An abducted child became his own witness testified against the accused. Testimony found to be reliable. Theory of "last seen together" is a good evidence, but not by itself. there must be circumstantial support. Direct evidence is not needed in divorce cases. A twelve year old child witnessed his mother's role in getting her husband killed by an other person. His testimony against his own mother was found to be reliable. Value of sec. 27 in the process of investigation, establishing chain of circumstances and identification of culprits and of articles involved in the crime has been appreciated by the Supreme Court. Section 32 has been found to be very useful in the conviction of killers of wives and children. Corroboration of a dying declarations have come before the Courts. The principle of protection against self incrimination has been applied in some cases. Where averments in a plant are not denied in the written statement, they amount to an admission. Value of newspaper reports has been examined in some cases as a matter of evidence.
